Throughout this document, the terms "we", "us" and "our" refer to Bags Beyond GbR, and "you" refers to our customer.

These Terms of Service apply to all requests and orders placed through our website. You accept them by ticking the corresponding box before submitting a custom request, and they become part of the contract when your order is confirmed. Simply browsing our website does not create any obligation on your part.

The contract language is English. We also correspond in German on request.


2. OUR PRODUCTS

Bags Beyond offers made-to-order leather bags.

All bags are made individually after a request or order has been reviewed and confirmed. This includes designs inspired by our sample pieces. Sample pieces shown on our website are design examples and starting points, not ready-made stock items.


3. HOW A CONTRACT IS CONCLUDED

Custom requests

Submitting a custom request through our website is free of charge and does not create a binding order. It is an invitation for us to review your idea. Before you can send the request, you are asked to confirm that you accept these Terms of Service; this acceptance does not oblige you to place an order.

After receiving your request, we review your idea and check whether it can be made. We may contact you for additional details, reference images or clarification.

After review, you may receive a personal quote by email. The quote states the price, the expected production time, shipping details and the next steps. Our quote is binding for us for 14 days from the date it is sent. If you accept it later, we may need to recalculate, for example because material prices have changed.

A contract is concluded only when you accept the quote and we confirm your order. Payment is then due as set out in section 5.

Orders through the shop

Where a piece can be ordered directly through our shop, your order is an offer to purchase. The contract is concluded when we confirm your order by email. An automated confirmation of receipt is not yet an acceptance of your offer.

We reserve the right to decline a request or an order if the design cannot be made, if the required materials are unavailable, if the design would infringe third-party rights, or if the request is outside our production possibilities. In that case no contract is concluded and any payment already made is refunded in full.


4. PRICES AND VALUE ADDED TAX

All prices are shown in euros and are final prices.

In accordance with section 19 of the German Value Added Tax Act (UStG), we do not currently charge value added tax and therefore do not show VAT separately.

For made-to-order pieces, the price depends on the design, size, leather, material, hardware, details and production complexity. There is therefore no fixed price list. For custom requests, the final price is confirmed in your personal quote before you decide whether to place an order.

Shipping within Germany and the European Union is free of charge.


5. PAYMENT

Payment is processed through Shopify. The payment methods available to you are shown during checkout and may include Shopify Payments, credit and debit cards, PayPal, Klarna, Apple Pay and Google Pay. We do not receive or store your full card details.

Payment must be completed before production begins.


6. RETENTION OF TITLE

The goods remain our property until the purchase price has been paid in full.


7. PRODUCTION AND THE NATURE OF HANDMADE GOODS

Each bag is made individually by hand from natural leather. Because of this, small variations in colour, leather texture, grain, measurements, hardware, details or finish may occur between one piece and another, and between the finished bag and the reference images.

Such variations are part of the handmade nature of the product and of working with a natural material. They are not defects, and the same applies to the natural darkening and patina that real leather develops over time.

This does not limit your statutory rights in any way. Where the bag genuinely deviates from what was agreed, or has a fault, section 10 applies.


8. DELIVERY AND SHIPPING

We currently ship within Germany and the European Union. Shipping is free of charge.

Production takes approximately 2 to 4 weeks from confirmation of your order, depending on the design.

Finished bags are brought from Indonesia to Germany in grouped shipments, checked by us in person, repackaged and then sent on to you. The delivery time stated in your order confirmation includes this step. Where a specific date has been agreed in writing, that date applies.

9. RIGHT OF WITHDRAWAL

Consumers generally have a statutory right of withdrawal of 14 days.

However, under section 312g (2) no. 1 of the German Civil Code (BGB), this right does not apply to goods that are made to your specifications or clearly personalised. Because our bags are produced individually according to your design, your custom order is generally excluded from the right of withdrawal.

Where you order an unchanged sample piece rather than a custom design, the statutory right of withdrawal applies in full.

10. STATUTORY WARRANTY FOR DEFECTS

Your statutory rights in the event of defects apply, in particular under sections 434 and following of the German Civil Code. The limitation period for claims relating to defects is two years from delivery.

A defect means that the bag deviates from what was agreed at the time it was handed over to you — for example faulty stitching, a broken clasp, or a bag that does not match the confirmed design. In that case you are entitled in the first instance to have the bag repaired or remade. Only if this fails, is refused or is unreasonable for you do further rights apply, such as reducing the price or withdrawing from the contract.

The following are not defects: damage caused after delivery, in particular through improper use, improper care, moisture, heat or accident; normal wear and tear; and the natural ageing, darkening and patina of leather described in section 7.

11. CANCELLATION BEFORE PRODUCTION

Independently of the statutory right of withdrawal, we try to be accommodating. If you wish to cancel your order, please contact us as soon as possible at info(at)bagsbeyond(dot)com.

Cancellation free of charge is generally possible as long as production has not yet started. Once cutting has begun, the materials have been reserved and work has been carried out, and cancellation is no longer possible.

If you want to change your design rather than cancel, contact us — before production starts this is usually straightforward.


12. YOUR RESPONSIBILITIES AS A CUSTOMER

You are responsible for providing correct and complete information when submitting a request or placing an order. This includes your name, email address, shipping address, design details, size preferences and reference images.

We are not responsible for delays or problems caused by information that is incorrect, incomplete or provided late.


13. REFERENCE IMAGES AND DESIGN REQUESTS

You may upload or send us reference images, sketches, screenshots or moodboards to help us understand your idea.

By submitting reference material, you confirm that you are entitled to share it with us for the purpose of reviewing and producing your request, and that doing so does not infringe the rights of third parties.

We do not reproduce protected designs. We will not make a 1:1 copy of a branded bag or of a design protected by trade mark, design right or copyright. References are used to understand the overall direction, shape, colour, material, mood and details of your idea. We therefore cannot guarantee that a reference item will be matched exactly, and we will tell you before production if something cannot be made as requested.

14. AVAILABILITY AND CHANGES

We may update, change or remove products, sample designs, prices, materials or services at any time. This does not affect contracts already concluded.

We may also update these Terms of Service. The version published on our website at the time your order is placed applies to that order.


15. CONSUMER DISPUTE RESOLUTION

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, and we do not currently participate in such proceedings.

If you have a concern, please contact us directly at info(at)bagsbeyond(dot)com. We would much rather resolve it with you than through a third party.


16. GOVERNING LAW

The law of the Federal Republic of Germany applies.

If you are a consumer with your habitual residence in another country of the European Union, this choice of law does not affect the mandatory consumer protection provisions of that country. The statutory rules on jurisdiction remain unaffected.


17. SEVERABILITY

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is not affected. The statutory provisions apply in place of the invalid provision.
